Section 1: Bidding on Objects
Before placing a bid, consider the following:
1. Buyer Protection
With Amstar Metals - Global Rarity Buyer Protection, your payments are secure, objects are quality-checked, and all sellers are verified.
2. Determining the Object’s Value
· Personal Value: Online auctions are about deciding what an object is worth to you.
· Market Value: If the object’s market value is important, consult a third-party appraiser. Purchasing for investment is at your own risk.
3. Estimates as a Guide
We may provide estimated values to help guide your bid. However:
· Estimates can change and are not guarantees of an object’s value or final selling price.
· They do not account for defects, restorations, or modifications.
· Always seek professional advice if needed.
4. Every Bid is Binding
· Once placed, bids and "Buy Now" purchases cannot be changed, canceled, or withdrawn.
· We are not responsible for bidding errors—always double-check your bid, especially last-minute bids.
· If you are the highest bidder or successfully use "Buy Now," you must pay for the object.
5. "Buy Now" Option
Some objects have a "Buy Now" option, allowing you to purchase immediately:
· The object is yours only after payment is completed and confirmed.
· If you place a bid on an object with a "Buy Now" option, another buyer may purchase it instantly, making it unavailable for bidding.
6. Check Import Laws & Additional Costs
· You are responsible for verifying import restrictions and additional costs (e.g., taxes, duties).
· Neither Amstar Metals - Global Rarity nor the seller is responsible for these costs.
7. Reserve Price Not Met
· Some objects have a reserve price (the minimum amount a seller will accept).
· If your bid is the highest but below the reserve price, no contract of sale is formed.
8. Objects Sold "As Is"
· Objects are sold in their current condition, which may vary due to age, wear, or restoration.
· Descriptions and images may not fully capture condition details. Colors may appear differently on-screen.
· Condition reports may be available upon request. If a seller does not mention the condition, it does not mean the object is new or flawless.
 Summary
✔ All bids and "Buy Now" purchases are binding.
✔ Carefully read the object description before bidding.
✔ We provide estimates as guidance, but professional advice is recommended.
Section 2: Contracts & Costs
1. Entering a Contract of Sale
· If you place the highest bid or use "Buy Now," you enter a sale contract with the seller, governed by our Terms.
· You are obligated to pay for the object. More details on buyer obligations can be found in Section 8 of the Buyer Terms.
· Some sellers may have additional terms, which will be displayed on the object page.
2. Buyer Protection Fee
To ensure a secure and expert-curated marketplace, we charge a Buyer Protection fee, which:
· Is usually 10% of the purchase price.
· Covers secure payments and expert review.
· Is non-refundable and displayed at checkout.
3. Additional Costs
· Buyers usually pay for shipping or transport costs.
· Additional costs may include VAT, import levies, insurance, payment method fees, or enhanced shipping services.
 Summary
✔ Winning a bid or using "Buy Now" creates a binding contract with the seller.
✔ You must pay the purchase price, Buyer Protection fee, and any additional costs.
Section 3: Paying for Your Object
1. Payment Options
We offer multiple payment methods. Some methods may include additional fees, which will be disclosed before payment.
2. Payment Deadline
· Auction wins: Payment is due within 3 days of the auction closing.
· "Buy Now" purchases: Payment is due immediately to secure your purchase.
3. Secure Payments
Your payment is held our wallet by our trusted payment provider until 3 days after you receive the object.
4. Late Payments
· If you fail to pay within 3 days, your bidding privileges may be suspended until payment is made.
· Non-payment may result in the cancellation of the sale by the seller or Amstar Metals - Global Rarity.
 Summary
✔ Pay within 3 days if you win an auction. Pay immediately for "Buy Now" purchases.
✔ Payments are securely held until the object is received.
✔ Late payments can lead to bidding restrictions or sale cancellation.
Section 4: Shipping or Pickup
Once you’ve paid for your object, we’ll inform the seller, and they will ship your object to the address you’ve provided or the one in your account. In some cases, you may need to pick up the object from the seller.
1. Contacting the Seller
After payment, you can message the seller directly to ask about the object, shipping, or arrange pickup. You can contact the seller from the order page.
2. Confirm Your Address
Ensure the address you provided is accurate, as the seller will ship to that location. The address must be physical, not a PO Box.
3. Pickup within 5 Working Days
If you choose to pick up, arrange it within 5 working days of payment unless otherwise agreed with the seller.
4. Late Delivery or Pickup
If the object is delayed or the seller doesn’t make it available for pickup, contact both the seller and us to resolve the issue. The delivery date is not a strict deadline—if the item arrives late, the sale is not automatically canceled. You can cancel the sale only if a solution is not found after sending a notice of default to the seller, allowing a reasonable timeframe for shipping or pickup.
5. Resolving Shipping Issues
If a shipping issue arises, contact the seller directly for a resolution. We may assist in resolving the issue.
6. Sharing Documentation
To resolve shipping problems, we or the seller may ask for photos, documents, or other information. Timely cooperation is important to help investigate and find a solution.
7. Possible Outcomes
If the issue can’t be resolved, we will decide on the outcome, which may include canceling the sale and issuing a refund, or paying the seller.
 Summary
Double-check your address for accurate shipping and contact us and the seller if issues arise. If you pick up, do so within 5 working days after payment.
Section 5: Receiving Your Object
It’s arrived! We hope you enjoy your special object. Take time to examine it carefully before placing it in its perfect spot.
1. Examining Your Object
When you receive your object, inspect it carefully to verify its nature, characteristics, and functioning—just like you would in a physical store.
2. Handle with Care
Most objects sold on Amstar Metals - Global Rarity are delicate. Be sure to handle them and any packaging with care. If you wish to withdraw from the purchase, and the object is damaged in a way that reduces its value, you will need to compensate the seller for the damage (excluding pre-existing or shipping-related damage).
3. Your Feedback Matters
Your feedback is important to both us and the seller. It helps improve our services. We encourage you to leave feedback about the object, seller, and overall experience.
 Summary
When your object arrives, examine it carefully to confirm it matches the description. Most importantly, enjoy!
Section 6: Concerns About Your Object
If you have concerns after receiving your object, we’re here to help.
1. Contact Us Within 3 Days
If the object is not as described or you have concerns, contact us within 3 days of receiving it. After this period, the payment provider will release the funds to the seller, and we may not be able to offer a refund. If you miss the 3-day window, contact the seller through our messaging system to work out a solution or request a partial refund.
2. Investigating Claims
If the object doesn’t match the description, provide us and the seller with detailed information so we can investigate the issue promptly.
3. Finding a Solution
If the investigation shows the object is not as described, potential solutions include:
· Repair, replacement, or reduction of the purchase price.
· Cancellation of the sale
Some solutions may only be available if you're purchasing from a professional seller.
 Summary
If you have concerns, contact us within 3 days of receiving your object. We will investigate and work with you and the seller to find a solution, which may include a refund or resolution with the seller.
Section 7: Returning an Object
If you're unsatisfied with the seller's or our solution, you may be able to cancel the sale and return the object. You will then receive a refund for the purchase price, and in most cases, the cost of shipping to you.
1. Right of Withdrawal
If you’re buying from a professional seller, you can withdraw from the purchase within 3 days of receiving the item. You must notify both the seller and us within this time. You will be responsible for the return shipping costs and transport.
If you're buying from a private seller, the right of withdrawal does not apply. If the object matches the seller's description but you're unhappy with it, you cannot cancel unless the seller agrees. In any of these cases, we will not refund the Buyer Protection fee.
2. Object Not as Described
If the object is not as described and you’ve sent the seller a notice of default with a reasonable deadline for repair, replacement, or another solution, but the seller doesn’t or can’t provide one, you can cancel the sale and return the object. Once the object is safely returned in its original condition, we’ll refund the purchase price and 50% of Buyer Protection fee.
3. Return Shipping
You are generally responsible for the return shipping costs. Additionally, make sure the object is adequately insured for return shipping or you’ll be responsible for the costs of any loss or damage if you choose not to insure it.
We recommend reusing the original packaging (if possible) to prevent damage. Also, check if there are specific shipping requirements for your item.
 Summary
In rare cases, you may return the object, especially if it’s not as described by the seller. If you return the item, you are responsible for return shipping and insurance costs (if applicable).
Section 8: Your Obligations
As a buyer, you have responsibilities to both Amstar Metals - Global Rarity and the seller. These obligations ensure fairness for everyone.
1. Pay on Time
If you place the highest bid, you must pay for the object (including applicable fees) within 3 days. If you use the Buy Now option, payment is due immediately.
2. Pay the Full Amount
If you’ve made a bid reservation (holding a bid amount on your credit card), you must pay the outstanding balance if you win the bid. If you don’t pay, you still need to pay the Buyer Protection fee. We will only release the reservation once you’ve paid the fee and contacted us.
Failure to pay can result in severe consequences, as outlined in Section 9 of these Buyer Terms.
3. Do Not File a Chargeback
If you pay but then file a chargeback (even if the seller fulfilled their obligations), your account may be blocked, and legal action may be taken against you. Please always reach out to us if there’s an issue with your object.
4. Pickup on Time
Make sure to pick up your object within the agreed time frame. If not, you may be liable for extra costs, like storage fees. We may also cancel the sale and keep the Buyer Protection fee.
5. Only Cancel for Legitimate Reasons
If you cancel multiple orders without valid reasons, we may suspend your ability to bid, your account, or impose penalties. Sellers can also claim damages or take action based on the contract of sale.
6. Abide by the Terms
It’s important to comply with our Buyer Terms, as well as other guidelines and policies. Non-compliance can result in penalties, as described in Section 9.
7. Resale Royalties
If you buy an original artwork, you may need to cover a resale royalty due to the artist. You’ll be required to reimburse Amstar Metals - Global Rarity or the artist’s representative if the royalty has been paid on your behalf.
 Summary
Ensure that you fulfill your obligations to both us and the seller, including making payments on time and only canceling orders for legitimate reasons.
Section 9: Consequences of Not Fulfilling Your Obligations
Failing to meet your obligations affects the trust and reliability of our marketplace and may result in consequences for you.
1. Consequences of Non-Fulfillment
If you fail to meet your obligations, we may suspend your ability to bid, your account, or cancel a sale. We will inform you of the action taken via email, including the reason behind it.
2. Enforcing Payment for Damages
If your failure to fulfill your obligations results in financial damage to us, we have the right to seek compensation for that loss. This can be done through a debt collection agency or legal proceeding.
We can claim statutory interest and additional costs associated with collecting the debt.
3. Reporting Fraud
If your actions are considered fraudulent, we may report you to law enforcement authorities.
4. Consequences for Sellers
If you don’t fulfill your obligations to the seller, sellers can also pursue their own actions, such as using debt collection services or legal action to enforce payment or claim damages.
In this case, sellers may also claim interest and any collection-related costs from you.
 Summary
Failure to fulfill your obligations could result in consequences such as account suspension, legal action, or claims for damages. We may also report fraudulent activity to the authorities.
