Seller Terms & Conditions

Section 1: Register as a Seller

To sell items on our online marketplace, you must register as a seller.

1. Create a Seller Account

When registering, you must declare whether you are a professional seller or a private seller:

· Professional Seller: You sell as part of a business, trade, or craft. You must provide your VAT identification number.

· Private Seller: You sell as an individual, such as a hobbyist.

Your seller status will be displayed with either a "PRO or "PVT" icon next to your name. Local laws may have additional criteria for seller classification. If you falsely register as a private seller, you are responsible for any resulting damage or claims, and Amstar Metals - Global Rarity will not be held liable.

2. Payment Providers

To ensure a secure selling environment, we work with third-party payment providers. You must create an account with the relevant provider when registering.

3. Additional Information Requests

For compliance reasons, we or our payment providers may request additional information. Failure to provide this may prevent you from selling on Amstar Metals - Global Rarity.

4. Incomplete Registration

Any incomplete registration will be saved for 90 days, and the selling of the item will start only after completion of the registration. If the registration is not completed within 90 days. The incomplete registration will be discarded.

Section 2: Professional Sellers

1. Compliance with Tax Regulations

As a professional seller, you must comply with all relevant laws and tax obligations, including VAT, goods and services taxes, and income taxes on your sales.

2. Certification of Compliance with Indian Law

By registering as a professional seller, you certify that the items you offer comply with applicable Indian laws and regulations.

3. Additional Responsibilities

Professional sellers have extra legal obligations towards buyers and Amstar Metals - Global Rarity. For example, buyers may have additional consumer rights when purchasing from you. You are expected to fully comply with these responsibilities.

4. Right of Withdrawal

If you sell to a consumer, they may have the right to cancel the sale within 7 days of receiving the item. If applicable, you are legally required to honor such requests.

5. Applying Your Terms & Conditions

You may apply your own terms & conditions in addition to Amstar Metals - Global Rarity’s Terms and the standard contract of sale, if they do not conflict with our policies. Any additional terms must be clearly stated in your item listing.

Summary

Professional sellers must follow local and international regulations, meet their tax obligations, and respect consumer rights.

 

Section 3: Submitting an Object for Sale

Once registered as a seller, you can submit your special objects for sale on our online marketplace. Please keep the following in mind:

1. Submission Guidelines

· Your object must meet our submission guidelines to be considered for auction.

· Even if your object meets the criteria, our experts may still reject it based on factors like auction demand.

· Repeatedly submitting false or rejected objects is not allowed and may lead to account suspension.

2. Object Evaluation

· We review your submission based on the description, photos, videos, and documentation you provide.

· Acceptance of an object is at our sole discretion and does not guarantee a sale.

3. Providing Accurate Information

You are responsible for ensuring your object listing is detailed and accurate. Required information includes:

· Condition & Classification (with supporting documentation if available).

· Country of Origin (including whether it remains in its original country).

· High-Quality Photos & Videos that clearly show the object’s current condition, including defects.

· Provenance & Authenticity (with certification if applicable).

· Necessary Documentation for registration, transfer, or export (if applicable).

· Reserve Price (if allowed for your object).

· Buy Now Option, if applicable.

· Shipping Costs & Duties, if relevant.

· Additional Sale Conditions (e.g., in-person viewing requirements).

4. Object Must Match the Description

The object must be exactly as described in your listing. If the description is misleading or inaccurate, buyers may have the right to:

· Request repairs, replacements, or refunds.

· Cancel the sale and seek compensation.

5. Adjustments to Object Descriptions

· We may edit or suggest changes to object descriptions before an auction starts.

· You can view any changes in your Seller dashboard before the auction goes live.

· We may translate object descriptions for international buyers.

· If your object has not yet been selected for sale, you can still edit your listing.

6. Responsibility for Object Description

· You guarantee that the final description accurately represents the object.

· If the description is misleading or incorrect, you may be held liable.

· Amstar Metals - Global Rarity is not responsible for any damage resulting from incorrect descriptions.

7. User Material

User material includes all descriptions, photos, certificates, specifications, and any other information provided with your listing. By submitting user material:

· You confirm it is accurate, appropriate, and not misleading.

· It must not include offensive, promotional, or spam content.

· It must not violate laws, infringe third-party rights, or harm Amstar Metals - Global Rarity’s reputation.

· If it contains personal data, it must comply with privacy laws.

8. License for User Material

By submitting user material, you grant us a global, non-exclusive, sublicensable, perpetual, and irrevocable license to:

· Use, reproduce, and promote your material across various formats and channels.

· Allow buyers to reuse descriptions and photos if they resell their purchased objects.

9. Object Estimates

· We provide estimated values for certain objects based on the information you submit.

· These estimates do not guarantee the final selling price.

10. Guarantee of Right to Sell

By offering an object for sale, you confirm that you:

· Are legally entitled to sell the object.

· Are not violating any laws, sanctions, or third-party rights.

· Are not engaging in fraudulent transactions (e.g., money laundering).

· Will ensure every sale is authentic and legitimate.

11. Exclusive Listings

· Objects listed on our marketplace must not be sold elsewhere simultaneously.

· If listed with us, you must remove them from other sales channels.

· However, Amstar Metals - Global Rarity at its discretion holds the right to place the object in another auction or other marketplace.

12. Buy Now Option

· Some objects may be available for immediate purchase at a set price.

· This option disappears when bidding reaches the Buy Now price or shortly before the auction ends.

Summary

When submitting an object for sale:
 Ensure all information and documentation is accurate.
 Your description, photos, and videos must truthfully represent the object.
 We may adjust, translate, or edit descriptions for clarity.
 You retain ownership of your materials but grant us a license to use them.
 You guarantee authenticity and the right to sell your object.
 Objects listed with us must not be sold elsewhere.

 

Section 4: When Your Object is for Sale

Once our experts approve your special object for sale, they will select the best auction to maximize interest and bidding activity. Once the auction is live, you can sit back and watch the bids roll in! However, please keep the following in mind:

1. Timing

· Our experts carefully choose the right auction for your object.

· This means there may be a delay between submission and when your object is listed for sale.

2. Object Availability

· Your object must remain available for sale from the moment you submit it until the auction or sales offer ends.

3. Adjusting Your Listing During Auction

· In some cases, you may be able to make minor adjustments while the auction is live, such as lowering the reserve price.

4. Withdrawing an Object

· You cannot withdraw an object once it has been accepted and scheduled for sale.

· In exceptional cases, we may grant approval to withdraw an object, but only if requested at least one day before the auction starts.

· Once an object is live, it cannot be withdrawn.

5. Consequences of Withdrawing an Object

· If you withdraw an object after it has gone live (or we approve its removal), you will be fully responsible for any resulting damage.

· You must indemnify us against third-party claims, costs, or losses.

6. Promoting Your Listing

· You may promote your listing through legitimate channels, such as your personal social media.

· However, promotion must:

Not suggesting you are affiliated with or representing Amstar Metals - Global Rarity.

Respect our brand and follow our User Communication & Anti-Harassment Policy.

· You cannot use our platform to promote your personal shop, website, or other sales platforms (e.g., adding links to external marketplaces).

· Sending unsolicited advertisements to Amstar Metals - Global Rarity users via email, post, or other means is strictly prohibited.

7. Prohibited Activities: Influencing the Sale

· Shill bidding (placing fake bids to manipulate demand or price) is strictly forbidden.

· Any actions that artificially influence bids or demand violate Section 9 of our General Terms.

· Engaging in these activities may result in account suspension, penalties, or further actions (see Section 13 of the General Terms).

8. Bid Removal

· We reserve the right to remove bids that are suspected of being fraudulent or in violation of our Terms.

9. Adjusting or Removing Your Listing

· If we find inaccurate descriptions or translation errors, we may adjust the object description.

· In special cases, to maintain marketplace integrity and reliability, we may remove the listing entirely.

Summary

We uphold transparent and fair auctions and expect the same from our sellers.
 Once your auction is live, you cannot retract your object.
 Any attempt to manipulate bids or demand is strictly prohibited.
 Unauthorized withdrawal of an object may result in penalties.

 

Section 5: Contracts and Costs

Congratulations! Your special object has found a new home. Before you prepare for shipping, here are some important details to keep in mind:

1. Entering a Contract of Sale

· When the auction ends, the buyer uses Buy Now, or you accept an offer, you automatically enter into a contract of sale with the buyer.

· This contract is governed by our Terms and requires you to fulfill specific obligations, including shipping the object.

2. Buyer’s Payment Responsibility

· Once the auction ends or an offer is accepted, the buyer must pay within 3 days.

· If the buyer selects Buy Now, payment is required immediately.

· Payments are processed through our secured payment system and held in our Wallet for at least 3 days after the buyer receives the object.

3. Taxes on the Purchase Price

· The purchase price includes any applicable taxes that you, as the seller, are responsible for.

· If required by consumer or tax laws, we may collect, report, and remit taxes on certain sales.

· In such cases, the buyer will pay applicable taxes at checkout.

4. Seller Fee

To connect you with serious bidders and buyers, we charge a fee to the seller as below excluding taxes if applicable.

· Seller will pay 5% of the seller’s anticipated value before placing the item.

· On successful sales of the item 10% of sale value will be deducted from the amount and balance will be paid to the seller.

· This fee is non-refundable.

· Fees may vary for certain categories—if this applies to your object, we’ll notify you in advance.

5. Payment Timeline

· The buyer must pay within 3 days of winning an auction or purchasing via Buy Now.

· You should only ship the object after receiving our confirmation that the buyer has paid.

· If the buyer fails to pay within 3 days, we will notify you.

6. Payment Delays and Sale Cancellations

· The 3-day payment period is not a legal deadline, meaning you cannot automatically cancel a sale if the buyer is late.

· If the buyer doesn’t pay on time, contact us—we can assist by sending a payment deadline notice.

· If the buyer still does not pay, in most cases, you’ll be able to cancel the sale.

7. Non-Payment and Transaction Cancellations

· If a buyer fails to pay, we may send reminders.

· If the buyer still doesn’t pay, we may cancel the transaction.

 When your object sells, you enter into a contract of sale with the buyer.
 The buyer is responsible for paying within 3 days and covering any additional costs (e.g., shipping, import fees).
 Once payment is received, it is held securely in our Wallet
 You must comply with your tax obligations related to the sale.

 

Section 6: Shipping or Pickup

Once the buyer’s payment is confirmed, we’ll notify you to proceed with shipping, transportation, or arranging pickup. To ensure a smooth process, please keep the following in mind:

1. Amstar Metals - Global Rarity’s Role in Shipping

· Amstar Metals - Global Rarity - is not responsible for shipping. We do not act as a shipping party or shipping company and cannot be held liable for damages that occur during shipping or transport.

2. Shipping Agreements & Responsibility

· When you ship or transport your object, you enter into an agreement with the shipping or transport company, not Amstar Metals - Global Rarity.

· If any issues arise, you must contact the shipping or transport company directly to request an investigation.

· We strongly recommend reviewing the terms and conditions of your chosen shipping company.

3. Shipping Guidelines

To ensure a successful delivery, follow these key guidelines:

a) Use Valid Tracking Information

· Objects must be shipped with a valid track & trace number.

· We highly recommend registered and/or insured shipping based on your object’s value.

· You are responsible for any damage or loss until the object is delivered.

b) Arrange Delivery or Pickup

· After payment is received, use our internal messaging system to coordinate shipping or pickup with the buyer.

c) Ship Within 3 Business Days

· Unless a pickup arrangement has been made, the object must be shipped within 3 business days of payment.

d) Properly Package Your Object

· Ensure the object is securely packed to prevent damage during transit.

· As the sender, you may be held liable for damages caused by inadequate packaging.

e) Use Shipping Insurance

· In most cases of damage or loss, the buyer will be refunded, and you may not receive compensation from the shipping company.

· To protect yourself, we strongly recommend shipping insurance.

4. Handling Shipping Issues

· If the object is delayed, lost, or damaged, communicate directly with the buyer first.

· If no solution is found, request an investigation with the shipping company.

· If you purchased Shipping insurance, contact the insurance partner immediately to start a claim.

5. Shipping Cost Adjustments

· If actual shipping costs are lower than the amount charged to the buyer, you must refund the excess amount.

· In some cases, we may refund the buyer on your behalf and deduct this amount from payouts.

· Artificially inflating shipping fees may result in penalties, including account suspension.

 


 

�� Shipping Restrictions & Prohibited Actions

To maintain fair practices, the following are not allowed:

1. No Dropshipping

· You cannot transfer shipping responsibility to a third party (e.g., manufacturer, wholesaler, retailer, or fulfillment center).

2. No Shipping from an Unregistered Address

· You must ship the object from the address listed in your Amstar Metals - Global Rarity account.

· If you use a different address, you will be liable for any extra fee costs.

3. No Shipping to Unsupported Countries

· If you ship to a country that is not supported, you may not receive payment for the sale.

4. No Unjustified Shipping Delays

· The estimated delivery date is not legally binding, meaning the buyer cannot automatically cancel the sale for a late delivery.

· However, if you unreasonably delay shipping, the buyer (or Amstar Metals - Global Rarity on their behalf) may issue a notice of default with a final deadline.

· If you fail to ship by the deadline, the contract may be canceled, and you could be liable for refunds and damages.

 


 

�� Summary

 You are responsible for the object until it safely reaches the buyer.
 We recommend insured shipping and proper packaging.
 No drop shipping or unapproved shipping addresses.
 Objects must be shipped within 3 business days unless a pickup is arranged.
 Late shipping or rule violations may result in canceled sales, refunds, or penalties.

 

Section 6: Payout of Sold Objects

Once the buyer has paid in full and confirmed satisfaction with the object, our payment providers will process your payout. The purchase price, minus the seller fee and any applicable costs, will be deducted and then be transferred to you.

1. Payment Processing & Terms

· Payouts are handled by our payment providers in a secure manner.

· Payments are subject to the terms and conditions of our payment providers, which may change over time.

· By selling on Amstar Metals - Global Rarity, you agree to follow these terms.

2. Exchange Rates & Currency Adjustments

· If your listing is in a different currency, our payment providers will apply the exchange rate in effect on the date your listing goes live.

· Your payout may be higher or lower in your local currency due to exchange rate fluctuations.

· In some cases, rounding adjustments may be made before the payout is processed.

3. Following Payment Provider Instructions

· To receive your payout, you must provide all required details as requested by our payment providers.

· If a payment provider blocks a transaction under their terms, Amstar Metals - Global Rarity may cancel the sale.

· Amstar Metals - Global Rarity is not responsible for any damages caused by a payment cancellation or failure by the payment provider.

4. Buyer’s 3-Day Inspection Period

· Buyers have 3 days from the delivery date to examine the object.

· If a buyer believes the object is not as described, they must contact us within this period.

· In special cases where the buyer cannot inspect the object within 3 days, we will notify you.

5. Payout Suspensions

a) Payout Suspension Due to Buyer Claims

· If a buyer opens a claim regarding your object and your payout has not yet been processed, we may suspend your payout until the claim is resolved.

b) Payout Suspension for Other Reasons

· Payouts may also be suspended if:

A third party raises concerns about the object or sale.

You fail to meet your obligations to Amstar Metals - Global Rarity or the buyer.

c) Right to Withhold Payouts

· If you violate our Terms, we reserve the right to withhold payment for the object.

· This may happen if the object is not as described or if you fail to meet selling requirements.

· In such cases, you forfeit any claims against us for the withheld payment.

 Payouts are processed by our payment providers, subject to their terms.
 Exchange rates may affect your final payout.
 Buyers have 3 days to inspect the object before payout is released.
 Payouts may be suspended due to buyer claims or other issues.
 We may withhold payment if you fail to comply with our Terms.

Section 7: Object Not Sold

While most objects sell successfully, there are cases where an object may not be sold, including but not limited to:

· Reserve price is not met: If you set a reserve price, but the highest bid in the auction does not reach it.

· No bids received: In the rare case your object does not attract any bids.

· Sale cancellation: If the buyer (or Amstar Metals - Global Rarity on their behalf) cancels the sale.

If your object is not sold, there are still ways to re-list and sell it through our marketplace. For more details, visit our Help Centre.

 


 

Section 8: Seller Obligations

As a seller, you have responsibilities to Amstar Metals - Global Rarity, bidders, and buyers. These obligations ensure a fair and transparent marketplace.

1. Responsibility for Your Objects

· You are fully responsible for the sale of your objects.

· You may be liable if you violate our Terms, a sales contract, or any applicable laws.

2. Authenticity & Accurate Descriptions

· All objects you sell must be authentic—no counterfeit or rights-infringing items.

· Your object description must be complete and accurate.

· Disclosing important details (e.g., damage, repairs) is mandatory. Misrepresentation may lead to purchase cancellation.

3. Your User Material Must Be Your Own

· You may only use images, descriptions, and content that belong to you or that you are authorized to use.

· Copying another seller’s object description is not allowed.

4. Fair Competition

· You may not interfere with other sellers’ listings.

· Disrupting another seller’s auction (e.g., bidding and not paying) or manipulating your own listings is prohibited.

5. Shipping & Delivery

· Once an object is sold and paid for, you must ship or transport it on time.

· Refusing to deliver without a valid reason (e.g., force majeure) may result in penalties.

6. Resolving Buyer Issues

· If an issue arises (e.g., shipping problems or object discrepancies), work directly with the buyer to find a solution.

· If an object is not as described, you may be legally required to offer repair, replacement, or partial refund.

· If you and the buyer cannot resolve the issue, Amstar Metals - Global Rarity may step in to mediate under the contract of sale.

7. Compliance with Laws & Regulations

a) Selling Laws & Environmental Regulations

· You must ensure your objects and packaging comply with all relevant import, export, and environmental regulations.

· If required, obtain import/export approvals and environmental certifications.

· Amstar Metals - Global Rarity is not responsible if you fail to comply with legal requirements.

b) Economic Sanctions Compliance

· You must adhere to applicable economic sanctions laws.

· You may not use financial institutions or third parties that would result in a violation of these laws.

8. Object Availability & Exclusivity

· Objects listed on Amstar Metals - Global Rarity must be exclusively available on our platform.

· You cannot sell them elsewhere while the listing is live.

· Withdrawing an object from a live listing may result in penalties.

9. Seller Guarantee of Conformity

· If you are a professional seller, you may be required to provide a legal warranty to consumers.

 You are fully responsible for your objects and must follow all applicable laws.
 Objects must be authentic, accurately described, and shipped on time.
 Work with buyers to resolve issues fairly.
 Listings on Amstar Metals - Global Rarity must be exclusive while active.
 Professional sellers may have additional warranty obligations.

Section 9: Failure to Fulfill Your Obligations

Failing to meet your obligations to us or our buyers affects the trust and reliability of our marketplace. It may also have consequences for you, as outlined below.

1. Consequences of Not Fulfilling Your Obligations to Us

If you do not meet your obligations, we may take actions such as:

· Suspending or removing your listings.

· Suspending your account or restricting access to our services.

· Cancelling a sale.

· Applying other measures as applicable.

In most cases, you will be automatically considered in default. Otherwise, we will notify you before taking action. If any of these measures are applied, we will generally inform you via email, explaining the reason.

2. Seller Account Restrictions

If we suspend or limit your account, we will attempt to inform you of the reasons.

If we decide to permanently restrict your access (i.e., terminate your account), we will try to provide 30 days’ notice unless:

· A legal or regulatory obligation requires us to terminate your access immediately.

· You have repeatedly violated our Terms.

3. Financial Consequences & Enforcement of Payment

If your failure to meet obligations results in financial loss for us, we have the right to recover damages, including:

· Deducting the owed amount from your outstanding balance.

· Pursuing legal action or using a debt collection agency.

· Seeking compensation through the Court of Law, where we can claim:

Statutory interest from the date of default.

(Extra-)judicial collection costs.

4. Reporting Fraud

If we identify fraudulent activities, we may report them to national or international law enforcement agencies.

5. Consequences of Not Fulfilling Obligations to Buyers

If you do not meet your obligations to a buyer, we may take actions outlined in Section 13 of our

 

General Terms.

Buyers also have the right to take action under their contract of sale, including:

· Enforcing delivery of the object.

· Seeking compensation for damages caused by your failure to comply.

· Using legal enforcement methods, such as a debt collection agency or pursuing a claim in court.

In these cases, the buyer may also claim:

· Statutory interest from the date of default.

· (Extra-)judicial collection costs from you.

Failing to meet your obligations may result in:
 Account suspension or restriction.
 Financial claims or legal enforcement.
 Fraud reports to authorities.
 Buyer claims for damages and compensation.

Section 10: Object Audits & Seller Inspections

To maintain quality and trust in our marketplace, we may conduct audits or inspections to verify the legitimacy, provenance, and quality of objects offered for sale.

1. Provenance Audit (Virtual Check)

We, or a third party on our behalf, may conduct virtual audits to assess an object’s:

· Legitimacy (authenticity & origin).

· Provenance (ownership history).

· Quality (condition & adherence to guidelines).

These audits may be conducted randomly or consistently across listings.

2. Physical Object Audit (Test Purchase)

We, or a third party may physically inspect the object that you have listed on Amstar Metals - Global Rarity:

· Accuracy against the description.

· Compliance with submission guidelines.

After the audit, the sale will be cancelled, and the object will be returned to you, unless agreed otherwise. You must refund us the full purchase price.

Objects That Pass the Audit

 Objects that pass the audit may be relisted and resold on Amstar Metals - Global Rarity.

Objects That Fail the Audit

 Objects that fail the audit will be returned to you and cannot be relisted.
 In cases involving counterfeit or illegal objects, we may destroy the object or hand it over to law enforcement.

3. Audit Costs & Financial Responsibility

· You must send the object to us at your cost.

· Our expert team will audit and the result will be communicated without giving any reason.

If your object fails, we may also take further measures, including penalties will be claimed.

4. Seller Inspections (Premises Visits)

To ensure compliance with laws, including economic sanctions, and to verify object legitimacy & quality, we may conduct physical inspections at your premises before listing objects on Amstar Metals - Global Rarity.

· You must bear the total round-trip expenses of our experts to audit the object at your place.

· If our experts visits your place for auditing the audit report will not be informed immediately, it will be thoroughly verified by the second level experts before the audit result is communicated to you.

 

5. Seller Responsibility

Even if your objects undergo an audit or inspection, you remain fully responsible for:
 The accuracy of your object descriptions.
 Compliance with all applicable regulations.

Amstar Metals - Global Rarity is not liable for any object’s selection, description, conformity, or quality, even if it has been audited or inspected.

 


 

�� Summary

 We may conduct virtual or physical audits to verify object authenticity and quality.
 If your object fails the audit, you may bear costs and penalties, and the object cannot be resold.
 Seller inspections may be conducted to ensure compliance.
 You remain fully responsible for your objects, regardless of any audits or inspections.
